Learned advocate appearing for the petitioner submits that the petitioner has been foisted with a criminal case immediately after he was released on bail in another criminal case and he has been shown to be in alleged possession of commercial quantity of Phensedyl. However, the subject matter of the case relates to recovery of commercial quantity of Codine Phosphate.

Learned advocate for the State opposes the prayer for bail and submits that charge sheet has already been submitted and the petitioner is the sole accused.

Having considered the stage of the case, the petitioner being the sole accused, I direct the learned Special Court to release the petitioner on bail after the stage of consideration of

charges are over, on such terms and conditions as the learned Special Court deems fit and proper to ensure the appearance of the accused.

Accordingly, CRM (NDPS) 1016 of 2025 is disposed of. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
