Fresh report as directed to be submitted has been presented by Mr. Sengupta, learned senior advocate. The fresh report was directed to be submitted to ascertain as to whether the private respondents are co-sharers as submitted in the report. It reflects that the private respondent nos.5 and 6 are co-sharers of the schedule property in respect of which complains have been lodged by the present petitioner.

In view of the nature of the accusations made, police authorities until and unless there is breach of peace will not interfere. Petitioner would be at liberty to approach the jurisdictional civil court with prayers relating to demarcation.

Police

authorities would ensure that there is a strict vigil and no breach of peace takes place and/or any untoward incidents arise because of the dispute relating to the land-in-issue.

With the aforesaid observations, WPA 19442 of 2024 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing on behalf of the petitioner.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
