It is submitted by Ms. Sudeshna Das, Learned Advocate-on-record that the instant appeal was filed by one Soubhagya Mondal, since deceased, against an order of acquittal against the respondents. After the death of the original appellant, the present appellant being the son of the original appellant was substituted. During the pendency of the appeal, the dispute between the parties has been amicably settled. The appellant stated in writing that he does not want to proceed with the instant appeal. Accordingly, the appeal is dismissed for non-prosecution.
