Banerjee) Ms. Sabita Khutia (Bhunya) Mr. Krishna Pada Santra ... for the petitioners Mr. Sabyasachi Mondal ... for the State This is an application by the legal heirs-daughters for disbursing arrear pension of their father. Learned advocate for the State prays for an adjournment, which is not granted.

Learned advocate for the State has intimated this court that only a proper legal heir certificate is required which is to be filed by the petitioners with the District Inspector of Schools and after such submission the papers will be forwarded to the appropriate authority for giving the arrear pension.

I direct the petitioners to take steps immediately for getting the legal heir certificate. If such application is made, the concerned District Magistrate shall give responsibility to any of his responsible subordinate officers to enquire into the matter of legal heir and the

legal heir certificate is to be issued within a period of two months from the date of filing such application for legal heirs. After receiving such certificate, the petitioners will file the same with the concerned District Inspector of Schools and the said District Inspector of Schools shall take further steps so that the arrear pension can be given to the said legal heirs, i.e., the daughters of the deceased teacher who converted his Contributory Provident Fund to General Provident Fund after retirement.

If necessary, the District Inspector may take steps for hearing of the petitioners in his office for taking further steps in this matter.

With the above observation and direction, this writ application is disposed of.
