Learned counsel for the opposite party at the outset has submitted the order which is assailed in the present petition, followed CRR 3505 of 2024 and Hon'ble Justice Joymalya Bagchi as His Lordship then was, vide order dated 3rd October, 2024 disposed of the petition reaffirming the order of the learned Judicial Magistrate.

Since the impugned order has already been undergone scrutiny of the Co-ordinate Bench of this Court, the court considers that there would be no purpose of continuing the present petition in any case. It is order of interim maintenance and the petitioner will have all the opportunities to bring the materials on record for enhancement of the same.

Hence keeping all the contentions open the present petition is disposed of with the direction to the learned Trial Court to take into account all the contentions be raised by the petitioner for enhancement of the maintenance and decide the matter expeditiously in accordance with.

This petition stands disposed of.
