And In Re : Sajal Kumar Dewan ..... petitioner Mr. Rahul Ganguly ... for the petitioner Mr. Rudradipta Nandy ... for the State It is submitted by the learned Counsel appearing for the petitioner that he has been falsely implicated in the instant case. A large sum of money was misappropriated by one of the employees, Soumen Bagui. The petitioner initially lodged first information report against him.

Learned Counsel appearing for the State opposes prayer for anticipatory bail and submits petitioner was the manager of a Customer Service Point and had received money from various customers. He, in collusion with co-accused persons, misappropriated a large sum of money over Rs.26,00,000/-. To cover his misdeeds, he lodged first information report implicating the co-accused persons only.

We have considered materials on record. A large sum of money over Rs.26,00,000/- from various customers was

misappropriated at the Customer Service Point managed by the petitioner.

In view of gravity of the offence involving extensive financial fraud, we are of the opinion custodial interrogation of the petitioner to trace out the ramifications of the crime and to collect further evidence, is necessary and this is not a fit case to grant anticipatory bail to him.

Accordingly, prayer for anticipatory bail is rejected. (Bivas Pattanayak, J.) (Joymalya Bagchi, J.)
