Toslim Ali ..for the Petitioner Mr. Arijit Ganguly Ms. Manisha Sharma .....for the State Learned advocate for the petitioner submits that the petitioner is in custody since March, 2020 and although chargesheet has been submitted and charge has been framed but there has been no progress in the evidence of the case. It has been also brought to the notice of this Court that the next date has been fixed on March 30, 2022 for evidence. However, no schedule has been fixed in respect of trial although the petitioner has been detained in custody for a considerable period of time.

Mr. Ganguly, learned advocate who usually appears on behalf of the State is directed to appear in this matter. His appointment may be regularized by the concerned authority. In view of the detention of the petitioner, the learned Special Court is directed that on and from March 30, 2022 the learned Court would fix a schedule consisting of three dates and such schedule should be fixed once in every three months, so that the trial of the case can be concluded within a reasonable period of

time. No unnecessary adjournment should be granted to either of the parties and schedule/date should be fixed only after the learned Public Prosecutor conducting the case assures the Court regarding the availability of the witnesses.

With the above observations, CRR 2469 of 2021 is disposed of.
