Mr. Bhagabat Chowdhury, Sk. Toslim Ali ...for the petitioner Mr. Subhabrata Datta, Mr. Sanatan Panja ...for the State Report submitted by Inspector-in-Charge, Domjur Police Station dated 10.02.2022 be taken on record. The petitioner is aggrieved by inaction of the Inspector-in-Charge of Domjur Police Station in failing to secure the presence of the accused in C.S. No.489 of 2020 dated 31st August, 2020 under Sections 406/417/420/34 of the Indian Penal Code.

It is submitted by the Inspector-in-Charge of Domjur P.S. through the learned counsel for the State, that the accused persons could not be arrested, in spite of summons, the accused warrants are outstanding and pending execution.

This Court directs the Inspector-in-Charge of Domjur P.S. to immediately move the learned Magistrate for proclamation and attachment against whom Warrant of Arrest have been issued. Warrants may also be

obtained against the other accused to bring them to face trial.

It is expected that the I.O. shall took steps as directed hereinabove within a period of one week from date.

It is expected that charge-sheet be submitted as expeditiously as possible.

W.P.A.19841 of 2021 stands disposed of.

Urgent photostat certified copy of this order, if applied for, be given to the parties, upon compliance of all formalities, on priority basis.
