The petitioner has applied for transfer within the district of Paschim Medinipur on the medical grounds of his wife.

Since the transfer of medical ground does not attract the pupil teacher ration or any other factor, the DPSC, Paschim Medinipur shall refer the medical condition of the petitioner's wife to the CMOH, Paschim Medinipur.

The petitioner shall produce his wife's medical records before the CMOH, Paschim Medinipur, who shall submit an opinion on the need for transfer of the petitioner on account of the medical condition of his wife. 4.

Upon receipt of such opinion, the Chairman, DPSC, Paschim Medinipur shall take an appropriate decision in accordance with law within a period of 12 weeks from the

date of receipt of a copy of this order along with a copy of this writ petition.

The earlier rejection by the DPSC, Paschim Medinipur shall not stand in any way of the consideration directed to be effected in terms of this order. 6.

With the aforesaid direction, the writ petition is disposed of.

7.

There shall be no order as to costs.
