16.01.2024 Srimanta Sl. No. 03 Ct. No. 655 IA No.:CAN/1/2023 in CO/2232/2013 Tarit Baran Ghosh -Vs.- Biswaranjan Ghosh & Anr.

Mr. Sounak Bhattacharya, Mr. Sounak Mandal ...for the opposite parties Petitioner is not represented.

Learned Counsel on behalf of the opposite parties is present.

It appears that the instant revisional application is preferred challenging the impugned order dated May 13, 2013 passed by the learned Trial Court. During the pendency of this revisional application, sole petitioner, Tarit Baran Ghosh expired on 25.07.2019. An application is taken out on behalf of the opposite parties that the said Tarit Baran Ghosh died leaving behind his heirs/legal representatives as mentioned in paragraph no. 5 of the application. Despite that no step has been taken on behest of the petitioner to incorporate/bring the heirs/legal representatives of the sole petitioner in the record. It is submitted on behalf of the opposite parties that the revisional application has already been abated due to non-impleading the heirs/legal representatives of the sole petitioner. In view of that the instant revisional application has already been abated. Moreover, there is no representation of the petitioner today. Accordingly, the instant revisional application is dismissed and abated.
