Report of the Superintendent of Police, Purba Bardhaman so submitted before this court be kept with the record. The Superintendent of Police, Purba Bardhaman would take steps so that all the witnesses the prosecution intends to rely upon is present before the court, within the period from 17th March, 2023 to 27th March, 2023.

As it has been informed by the petitioners and the private opposite parties that 17th March, 2023 has been fixed for the next date by the learned Additional Sessions Judge, Katwa for argument of the case, I direct that the hearing of the argument be kept in abeyance. An opportunity be granted to the prosecution to adduce all its evidence between 17th March, 2023 to 27th March, 2023. The learned trial court would fix for the purposes of this case

each and ever date from 17th March, 2023 to 27th March, 2023. The prosecution would take endeavour to produce the rest of the five witnesses or any of the witnesses out of those five witnesses on whom they intend to rely. There is already an indication in the report submitted by the Superintendent of Police, Purba Burdwan. Let this process of examination of the evidence be completed by 27th April, 2023.

The learned trial court will thereafter, if required, again complete the process of Section 313 of the Code of Criminal Procedure, grant opportunity to defence to adduce its evidence and thereafter fix dates for argument of the case. With the aforesaid observations, the revisional application being CRR 2471 of 2021 is disposed of.

Pending applications, if any, are consequently disposed of. Mr. Ali, learned advocate for the State is directed to communicate this order to the Superintendent of Police, Purba Burdwan so that effective steps can be taken by this office for ensuring implementation of the aforesaid order. The Registrar (Judicial Service), High Court, Calcutta will communicate this order to the learned trial court by 3.00 PM on 15.03.2023.
