Case No. 1247 of 2024 dated 03.08.2024 was registered on the basis of a complaint of Anowar Hossain Jamader (the present petitioner) and the Investigating Authority on completion of investigation has submitted charge-sheet before the learned jurisdictional court.
The petitioner, now, is aggrieved of the fact that in spite of status quo
order being passed in Title Suit No. 280 of 2024, the illegal construction is progressing at the instance of the private respondent(s).
The police authorities are not responsible for interfering with legality or illegality of construction.
The petitioner would draw the attention regarding the legality or illegality of the construction by way of submitting a representation before the Block Development Officer and/or, any other authority, who are responsible for deciding the legality or illegality of the construction and for implementation of any Civil Court's order relating to the same.
So far as the issue relating to grievance of the police authorities are concerned, the same has been addressed, as charge-sheet has been submitted before
the learned jurisdictional court.
With the aforesaid observations, WPA 19446 of 2024 is disposed of.
Pending application, if any, is also disposed of.
Case Diary be returned to the learned advocate appearing on behalf of the State.
