It appears from the report submitted on behalf of the State respondents that upon demarcation of the plot in question which was held in presence of the petitioner it was found that the petitioner has encroached upon 0.0096 acres of land belonging to the State. The demarcation report and sketch map annexed thereto have not been disputed by the petitioner. The petitioner undertakes to remove such encroachment and restore possession of the said portion of the plot in favour of the State.

Learned counsels for the respondents submit that such exercise be done in presence of the respondents. By consent of the parties, such encroachment shall be removed by the petitioner in presence of the respondents on 11th February, 2024 from 11 am.

On prayer of the State respondents liberty is granted to videograph the entire exercise at the cost of the State.

Since nothing further remains to be adjudicated in the writ petition, the same is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
