This application under Article 227 of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Division), Additional Court, Hooghly at Chinsurah to dispose of the pending interlocutory applications in Title Suit No.211 of 2004 expeditiously.

Mr.

Mukherjee, learned Senior Advocate appearing for the petitioner, submits that the defendant no.6/opposite party no.6 herein obtained an order for expeditious disposal of an application under Order 12 Rule 6 by totally suppressing the fact that several other interlocutory applications, which are prior in point of time, are still pending.

Mr. Mukherjee further submits that such applications have a bearing on the application filed by the defendant no.6 under Order 12 Rule 6 of the Code of Civil Procedure.

Mr. Mukherjee further submits that the learned Trial Judge by an order dated 07.08.2025 directed the parties to submit a list of pending applications on

18.08.2025. The learned Trial Judge would be free to decide as to which of the pending applications shall be taken up first.

C.O. No.2944 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Division), Additional Court, Hooghly at Chinsurah to make an endeavour to dispose of the pending interlocutory applications in Title Suit No.211 of 2004 expeditiously without granting any unnecessary adjournment to either of the parties provided the same are otherwise ready for hearing.
