The present case was initiated under Sections 341/323/354B/506/34 IPC pursuant to the complaint lodged by one Krishna Chatterjee, private opposite party. The complainant expired during the pendency of the present case. As such this court in order to ascertain regarding other ladies who were witnesses to the case directed the State to get their statement recorded so far as the persuasion of the case relating to Baranagar P. S. Case No. 105 of 2021 is concerned. Today a report is submitted enclosing the statement of Baby Das @ Dey and Soma Ghosh. Both the ladies in their statement have submitted that they are not interested to pursue the criminal case which was initialed by Krishna Chatterjee. Having considered the same, I am of the opinion that further continuance of Baranagar P. S. Case No. 105 of 2021 dated 24-02-2021 pending before the learned Additional Chief Judicial Magistrate, Barrackpore is hereby quashed. Consequently, the present revisional application being CRR 2913 of 2023 is allowed.

Pending applications, if any, are consequently disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this court. [Tirthankar Ghosh, J]
