AB C. O. 2950 of 2025 M/s. Vijai Shree Private Limited Vs Board of Major Port Authority for Syama Prasad Mookerjee Port Mr. Shyamal Sarkar, sr. adv, Mr. Debjit Mukherjee, Mr. Rajesh Gupta, Mr. Debangshu Dinda .....for the Petitioner. This application under Article 227 of the Constitution of India is at the instance of the appellant in Misc. Appeal No.161 of 2022 and is directed against an order being no.14 dated June 3, 2025, passed by the learned Additional District Judge, FTC-II at Howrah.

The learned senior advocate appearing for the petitioner submits that an interim order of stay of operation of the order passed by the Estate Officer was passed by the learned Judge of the Appellate Court on 19.11.2022. He submits that the said interim order was extended from time to time. He further submits that through oversight, the petitioner could not take steps for extension of the interim order on 29.01.2025 for which the order of stay stood vacated.

He further submits that the petitioner filed an application for extension of the interim order immediately thereafter. He further submits that the

petitioner also filed a supplementary affidavit praying for re-imposition of the interim order. He submits that the learned Judge of the Appellate Court be directed to hear out the said application for extension of the interim order along with the supplementary affidavit expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite party.

However, the learned advocate appearing for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or upon the learned advocates representing them before the Appellate Court. From the order-sheets appended to this revisional application, this Court finds that August 28, 2025 is fixed for hearing of the petition dated June 3, 2025 and for filing the written objection in the meantime.

In view thereof, C. O. No.2950 of 2025 stands disposed of by requesting the learned Additional District Judge, FTC-II, Howrah to take up the hearing of the petition dated June 3, 2025 along with the supplementary affidavit on the next date fixed i.e. on August 28, 2025 and to make an endeavour to dispose of the same on that date itself. If for any reason whatsoever, the same cannot be disposed of on that date, the learned Judge of the Appellate Court is

requested to fix an early date of hearing of such application considering the urgency involved in such application.
