-versusShri Sankar Paul Mr. Subhadeep Chatterjee ... for the petitioners This application under Article of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court at Barrackpore to dispose of the pending application in Ejectment Suit No. 7 of 2016 expeditiously.

The learned advocate appearing for the petitioners submits that the applications under Section 7(1) and Section 7(2) of the West Bengal Premises Tenancy Act, 1997 and an application under Order 6 Rule 17 of the Code of Civil Procedure are pending. He further submits that the Co-ordinate Bench by an order dated 29th January, 2024 in C.O. 80 of 2024 directed the learned trial judge to dispose of the applications expeditiously. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.

However, the learned advocate appearing for the petitioners shall be obliged to forward a copy of this application along with this order upon the

opposite parties or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioners, C.O. 2952 of 2025 stands disposed of by requesting the learned Civil Judge (Junior Division), 2nd Court at Barrackpore to make an endeavour to dispose of the pending applications as expeditiously as possible without granting any unnecessary adjournments to either of the parties keeping in mind the directions contained in the order dated 29th January, 2024 passed by a Co-ordinate Bench in C.O. 80 of 2024.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
