The petitioner filed the writ petition praying for a direction upon the Howrah Municipal Corporation to demolish the unauthorized construction at 11, Kundan Bye Lane Liluah, P.O. and P.S.- Liluah, DistrictHowrah, Pin-711204. It has been submitted by the learned advocate appearing for the petitioner that presently the property falls under the jurisdiction of Bally Municipality. Learned advocate appearing for the petitioner submits that after filing of the writ petition, his client received certain information from the Bally Municipality pursuant to which he is not interested to proceed with the writ petition any further.

A written instruction has been given by the petitioner to the learned advocate disclosing his intention not to proceed with the pending case. In view of such submission, W.P.A. 19876 of 2021 stands dismissed as 'not pressed'.

The written instruction given by the petitioner to the learned advocate signed on 20th December, 2022 be taken on record.

The information provided by the Bally Municipality to the petitioner in January 2022 be also taken on record.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
