The petitioner is a retired employee of Calcutta Tramways Company (1978) Limited (in short, CTC) now known as West Bengal Transport Corporation (in short, WBTC). The petitioner retired from the services on 30th November, 2011 after attaining the age of superannuation.

The petitioner says that the petitioner was not given the arrears of Dearness Allowance (in short, DA) payable as per West Bengal Services (Revision of Pay and Allowances) Rules, 1996 (in short, ROPA, 1996).

The petitioner says that during the pendency of the writ petition the employer of the petitioner has explained to the petitioner that whatever benefit the writ petitioner was entitled to under ROPA, 1996 has been duly given to the petitioner. The petitioner has accepted such explanation and is not willing to

proceed any further with the writ petition. The writ petition therefor stands dismissed for nonprosecution.
