Ms. Sabnam Majumder Ms. Kalpita paul ... for the Petitioner(s) Mr. Sudipta Panda Ms. Mousumi Banerjee ... for the State - Respondent(s) Re The petitioners are aggrieved by the fact that inspite of a decree having been passed in TS 963 of 2005 on or about July 17, 2025, when they had been to the place/land for measurement relating to construction of a boundary wall, they had been assaulted and, inspite of informing the same to the police authorities, no steps were taken.

Learned advocate for the State has submitted a report which reflects that the petitioners approached the learned court for execution of the decree but the

same was rejected, thereafter, a revisional application was preferred which is pending before this Hon'ble Court being CO 2497 of 2018.

The police authorities, having regard to the nature of the dispute, have drawn up a proceeding under Section 126/135(3) of the BNSS for maintaining peace and tranquility.

Having considered that the police authorities are well aware regarding the strained relationship existing between the petitioners and the private respondents, I am of the view that the police authorities would act only pursuant to the directions of the civil court.

However, in case, there is violation of any law and order, the police authorities would ensure that the same is not blown out of the proportion.

With the aforesaid observations, WPA 18792 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the petitioner.
