25.08.2022 sdas rejected C.R.M.(DB) No. 2869 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Kaliagunge Police Station Case No. 332 of 2009 dated 16.07.2009 under Sections 363/366/34 of the Indian Penal Code.

And In Re : Chand Mohammad Sk. @ Chandu ..... petitioner Mr. Habibur Rahaman ... for the petitioner Ms. Mausumi Sarkar ... for the State Learned Counsel appearing for the petitioner submits he is in custody for 104 days. He prays for bail. Learned Counsel appearing for the State opposes prayer for bail.

We have considered materials on record. He had absconded for over a decade. Statement of the victim recorded under Section 164 of the Code of Criminal Procedure shows petitioner had trafficked her to a different State. In view of the aforesaid circumstances, we are not inclined to grant bail to the petitioner.
