Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner is aggrieved by the fact that warrant of arrest which has been issued in connection with M. Ex. 142 of 2021 has not been executed and the private respondent no.5 is evading the process of law. There is another execution case being M. Ex. 80 of 2023.

Having regard to the fact that the private respondent no.5 is not traceable, I direct that the learned Additional Chief Judicial Magistrate, Barasat in seisin of the issue would on the next date so fixed direct the warrant of arrest or the distress warrant to be executed through the Missing Persons Bureau, CID, Bhabani Bhaban, West Bengal. The Officer-in-Charge of the said department would submit a progress report before

the said court on each and every month till the private respondent no.5 is traced out.

With the aforesaid observations, the writ petition being WPA 18810 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
