The petitioner is aggrieved due to nonconsideration of his application for permanent stage carriage permit i.e. dated January 24, 2022, by the respondent no.2, RTA Purba Medinipur.

Ms. Pramanik, learned advocate appearing for the petitioner has sought for an order directing the respondent no. 2 to duly consider such application of the petitioner.

Mr. Sen, learned advocate is appearing for the State respondent.

Mr. Sen is of the opinion that with respect to an application filed by the petitioner with adequate statutory fees there for, the respondent authority would be legally bound to consider the same. He seeks an appropriate order in this case.

Sofar as the application of the petitioner dated January 24, 2022 is concerned, the same is not annexed

with any copy of challan showing submission of statutory fees by the applicant/petitioner.

Accordingly, the Court is inclined to dispose of this revision directing the present petitioner to submit the statutory "Form-I" afresh, for grant of permanent stage carriage permit, along with the applicable statutory fees for the same, before the concerned authority. The respondent no. 2 is directed to receive the same and consider the application of the petitioner as above, when filed and take a decision about the same, within a period of eight weeks from the date of his submission of the fresh application form along with the prescribed fees.

The decision of the respondent no. 2 with regard to the application so filed by the petitioner, if any, be communicated to the petitioner within one week from the date of its order.

The writ petition No. WPA 19437 of 2024 is disposed of.
