Affidavit-of-service has been filed by the opposite party no. 3 showing that he has duly served upon the petitioners. 2.

The learned counsel for the petitioners is found absent, in spite of due service of notice.

Learned counsel for the opposite party no. 3 and the State are present.

The present revisional application has been preferred praying for quashing of the proceeding being G.R. Case No. 897 of 2022 arising out of Posta P.S. Case No. 114 of 2022 dated 27th July, 2022 under Sections 120B/419/420/406 of the Indian Penal Code, pending before the learned Additional Chief Metropolitan Magistrate, Calcutta. 5.

Learned counsel for the State files a memo of evidence from which it appears that the investigation in this case has ended in a final report (Mistake of Fact). The said status of the case thus makes it clear as to why the petitioners are not appearing before this Court.

Considering the said status of investigation, the present revisional application has now become infructuous and is accordingly disposed of as 'infructuous'.

Liberty is granted to the opposite party no. 3, to pray for appropriate relief before the appropriate forum. 8.

All connected Applications, if any, stands disposed of. 9.

Interim order, if any, stands vacated.

10. Copy of this order be sent to the learned Trial Court for necessary compliance.

11. Urgent certified website copy of this order, if applied for, be supplied expeditiously after complying with all, necessary legal formalities.
