1. This is an application under Section 401 read with Section 482 of the Code of Criminal Procedure filed by the petitioner for quashing of the impugned proceeding being CGR Case No.2023 of 2010 pending before the Court of the learned 10th Judicial Magistrate, Alipore and the impugned FIR being FIR No.97 dated 09.06.2010 and the charge sheet being Charge Sheet No.127 of 2010 dated 11.08.2010 in connection with FIR arising from the Garden Reach Police Station Case No.97 of 2010 under Section 353 of the Indian Penal Code.

2. Mr. Arif Ansari, learned advocate appears on behalf of the petitioner as a junior of Mr. Pal, learned advocate-on-record of the petitioner and submits that the petitioner is not willing to proceed with the revisional application and to that extent one letter of the petitioner has been placed before the Court countersigned by Mr. Ansari. Let the letter be kept on record. It further transpires from the record that the matter is pending since 2015. No stay order was granted earlier. In view of the same and considering the prayer made by the petitioner, this revisional application is dismissed as non-prosecution.

3. Let a copy of this order be sent to the learned trial Court for information.
