1. Heard learned lawyers for the parties.

2. We have considered the materials on record. Statements of witnesses and contemporaneous documents and the seizure memorandum show recovery of 290 bottles of phensedyl syrup containing codeine phosphate about commercial quantity from petitioner. Charges have been framed and date has been fixed for prosecution evidence.

3. Under such circumstances and in view of the statutory restrictions under Section 37 of N.D.P.S. Act we are not inclined to grant bail to him.

4. We request the learned Trial Court to expedite the trial and conclude it at an early date.
