The case of the petitioner is that the petitioner's father died in harness on 17th July, 2021 while serving as a Group -D employee in the concerned College. The petitioner's father joined the service on 1st June, 1991 and was confirmed by a Memo dated 4th June, 1993.

According to learned counsel appearing for the petitioner, the petitioner has not received the death benefits which were due to her father even after making various representations to the College as well as the Director of Public Instruction. An application under RTI was replied to by the College on 12th November, 2021 stating that all formalities

have been completed by the College. Counsel submits that despite the same, the petitioner has not received any financial benefit till date.

The State is represented.

Upon considering the materials on record, this Court deems it fit to direct the Director of Public Instruction to whom the representation dated 29th October, 2021 was made to dispose of the same by way of a reasoned order after hearing all concerned parties including the petitioner. The reasoned order should be passed within a period of four weeks from the date of communication of this order and the copy of the same be given to the petitioner within a week from the date on which such reasoned order is passed.

Needless to say, if the petitioner is found to be eligible to the death benefits of her father the same shall be disbursed by the concerned respondent within four weeks thereafter but not later than 31st March, 2022.

WPA 19927 of 2021 is disposed of in terms of the above.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
