Learned advocate appearing for the petitioner submits that already steps have been taken by the BSF authority and the learned Special Court has accepted the charge-sheet and fixed date on October 17, 2023, as date for consideration of charges.

The petitioner is in custody since August 11, 2022 i.e., for a period of 13 months. If the learned Special Court/Trial Court is of the opinion that the trial of the case should be conducted after consideration of charges then in that case, the trial Court would fix a schedule consisting of three dates and fix that schedule once in every sixty days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournments be granted to any of the parties.

The Superintendent of Police of the concerned district would assist the learned Court to ensure regarding the

presence of the witnesses on the date so fixed. The Public Prosecutor conducting the case would produce the materials, documents and exhibits on the date so fixed for examination of the witnesses are concerned. All the stakeholders would cooperate with the learned Trial Court so that at the earliest the trial of the case is concluded.

With the aforesaid observations, the present revisional application being CRR 2924 of 2023 is disposed of. Pending applications, if any, are disposed of. All concerned parties are to act in terms of a copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
