Learned advocate appearing for the petitioner submits that there has been continuous interference, torture and assault being inflicted by the private respondents.

To that effect, information was furnished and a case being Uluberia P.S. Case No.353 of 2025 dated 23.07.2025 has been registered for investigation. However, petitioner further complains that the aggression of the private respondents still continues.

State has submitted a report. Report reflects that there is a title suit pending being T.S. No.316 of 2025 before the learned Civil Judge (Junior Division), 1st Court, Uluberia, Howrah. The criminal case is still under investigation.

Having considered the prayer of the petitioner that he is facing inconveniences and/or threats/assault in spite of a criminal case pending, I direct that the petitioner would inform the jurisdictional Magistrate in seisin of the criminal case who would assess regarding the threat perception of the petitioner and thereafter pass necessary directions under the Witness Protection Scheme, 2018.

With the aforesaid observations, WPA 18825 of 2025 is disposed of.

There will be no order as to costs.

Report so submitted be kept with the record.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
