The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite parties, as such, service of notice of the present application upon the said opposite parties is dispensed with.

The petitioners are the defendants Nos. 1(a) and 1(b) of the Title Suit No. 81 of 2023, a suit for declaration of title pending before the 1st Court of learned Civil Judge, (Junior Division) at Sealdah, District - 24 Parganas (South).

The petitioners are complaining delay in disposal of the said suit.

It appears from the record that the witness action of the suit has started and there is already a request made on March 21, 2017for expeditious disposal of the said suit in C.O. 2378 of 2016; the learned Trial Judge, adhering to the said request, shall take appropriate steps in accordance with law for disposal of the said suit, and in doing so, shall not entertain the prayer of the parties for any unnecessary adjournment.

C.O. 2776 of 2024 is disposed of with the above terms without any order as to costs.
