The grievance of the petitioner is that some of the sections, which according to the materials collected by the investigating agency, would reflect that the offences relating to the heinous nature could have been a part of the charge-sheet, the same has been purposely omitted by the investigating officer which has seriously prejudiced the petitioner. Records reflect that the investigating agency after conclusion of investigation has submitted charge-sheet in connection with Ramnagar Police Station Case No.565 of 2023 dated 07.09.2023 and

the said charge-sheet was submitted at or about 30.09.2023. The jurisdictional court is now in seisin of the proceedings. There is nothing on record to show that any notice has been issued to the de facto complainant.

As such, in case the de facto complainant takes out any application under Section 173(8) of Cr.P.C or Section 193 (9) of BNSS, the learned jurisdictional court will take the same into consideration and dispose of the same in accordance with law.

With the aforesaid observations, WPA 19511 of 2024 is disposed of.

Pending connected application, if any, is consequently disposed of.

There will be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
