The petitioner complains that her sons have wrongfully ousted her from her residence.

Counsel for the private respondents submits that the petitioner herself, through and/or with collaboration of her husband, sold the residence to a third party. The sons are now living with their in-laws and the question of their preventing the petitioner to enter into the house does not arise.

The petitioner submits that she is staying on charity.

This Court notices that the disputes are civil in nature and the matter does not call for interference under Article 226 of the Constitution of India. The petitioner may apply under the Senior Citizens Act for appropriate relief of maintenance and other remedies available to her in accordance with law.

With the aforesaid observations, the writ petition is disposed of.

There shall be no order as to costs.

The report of the Officer-in-Charge, Tangra Police Station, Kolkata dated 27th September 2022 is taken on record.
