Petitioner is aggrieved by the delay in progress of the case being CS No.20729 of 2020.

Learned advocate for the petitioner draws the attention of the court and submits that till date the examination of the complainant is not over and the application under Section 143A of Negotiable Instrument Act is pending for the considerable period of time and the next date has been fixed on 15th September, 2023. In view of the anxiety expressed by the complainant/petitioner, I am of the opinion that the same is justified as almost 3 years have completed since initiation of the complaint case.

Learned Metropolitan Magistrate, 5th Court, Calcutta is directed to dispose of the application under Section 143A of the N.I. Act on the next date so fixed or within a fortnight thereafter.

Learned Metropolitan Magistrate would fix at least a date in every 60 days so that the trial of the case be concluded at the earliest.

With the aforesaid observations, CRR 2925 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
