Mina ...for the State The grievance of the petitioners is directed against inaction on the part of the respondent authorities and, more particularly, the Pradhan, Madhabpur No. 1 Gram Panchayat, being the respondent no. 4 herein.
It is submitted on behalf of the petitioners that despite an earlier order dated June 14, 2019 passed in W.P. No. 9284(W) of 2019, there has been complete inaction of the respondent authorities and the representation of the petitioners complaining of illegal construction has not been disposed of till date.
The State respondents are represented and undertake to ascertain from the concerned Gram Prodhan, being the respondent no. 4, as to why the representation of the petitioners has not been
disposed of in terms of the order dated June 14, 2019 and further ensure expeditious disposal of the same.
In view of the above, no purpose would be served in keeping the proceeding pending.
Accordingly, W.P.A. No. 19168 of 2022 stands disposed of by directing the respondent no. 4 to take expeditious steps in disposing of the representation of the petitioners dated July 23, 2022, preferably within a period of eight weeks from the date of communication of this order on the said respondent.
The State respondents also undertake to inform the respondent no. 4 of the passing of this order and to take necessary steps in accordance with law. It is made clear that there has been no adjudication on the merits of the case and all points are left open to be decided by the respondent no. 4 strictly in accordance with law.
There shall be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
