It is the grievance of the petitioner that although he applied for an electricity connection for his submersible pump set, the WBSEDCL declined to provide such connection. On the other hand, a connection has been granted in favour of respondent no. 5.

Respondent no. 5 is not represented.

Let the affidavit-of-service filed on behalf of the petitioner be kept with the record.

Mr. Kanak Kiran Bandhopadhayay, learned advocate appearing for the WBSEDCL, submits that the zone in which the petitioner applied falls within the semi-crucial zone.

Mr. Mukherjee, learned advocate for the petitioner, submits that his client shall make a fresh application in accordance with law.

In view of the above, the writ petition is disposed of by granting liberty to the petitioner to make a fresh application for electricity connection to his submersible pump set. If such fresh application is made, the same shall be considered by the WBSEDCL in accordance with law within a period of four weeks from the date of its receipt.
