Petitioner is aggrieved by the fact that although the case being CS No.91688 of 2021 was initiated on or about November 21, 2021 but till date only the examination under Section 251 Cr.P.C. is over and the application under Section 143A of N.I. Act is still pending. Learned trial court has been pleased to fix 23rd August, 2023 is the next date for hearing of the said application.

Having considered the plight expressed by the petitioner, the same is justified.

Learned Metropolitan Magistrate, 10th Court, Calcutta is directed to dispose of the application under Section 143A of N.I. Act on the next date so fixed or within a fortnight thereafter. Learned trial court thereafter would fix at least a date in every 60 days for the purpose of trial of the present case so that the complaint case be concluded at the earliest.

With the aforesaid observations, CRR 2926 of 2023 is disposed of.

Pending application, if any, is consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of such requisite formalities.
