Petitioner is aggrieved by the manner in which the investigation is progressing and complains that in spite of anticipatory bail being rejected by the learned Sessions Judge, no steps have been taken by the Investigating Officer of the case to trace out the accused persons.

State has submitted a report which includes amongst others the statement under section 183 of BNSS of one Devjani Sengupta Roy, Branch Relationship Head of Axis Bank, Lake Town Branch. The police authorities have also referred to certain history of the petitioner.

I have considered the manner in which the facts have been narrated in the report and I am of the view that the police authorities have arrived at

their conclusion after effective investigation. Report also reflect that a final report as mistake of fact have been submitted before the learned ACJM, Sealdah. Having considered the same, if the petitioner is aggrieved, petitioner will approach the learned Magistrate for further investigation by invoking the relevant provisions of law. Learned Magistrate would assess and ascertain regarding the subject matter of grievance of the petitioner and thereafter pass necessary orders as he deems fit and proper.

With the aforesaid observations WPA 18838 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
