October 1, 2021 ARDR (5) WPA 17704 of 2019 Niranjan Bar & ors.

Vs.

The State of West Bengal & Ors.

Mr. Rajdip Ray, Mr. Swapan Kumar Kar, Mr. Rohit Banerjee, ...for the petitioners.

Mr. Chandi Charan De, Mr. Anirban Sarkar, ...for the State.

Heard the learned counsels for the parties.

The allegation of the petitioners is that their plot of land was acquired by the authorities in 1981, but they have not been paid any compensation for the same till date.

On direction passed by this Court, the State authorities have filed a report stating the amount of compensation payable to the petitioners. The innocuous prayer of the petitioners is disbursement of the said amount at the earliest.

Having heard the learned counsel for the petitioners and considering the material on record, the writ petition is disposed of with a direction upon the State authorities to disburse the compensation amount in favour of the petitioners within a period of four months from the date of communication of this order, in accordance with law.

With the aforesaid directions, WPA 17704 of 2019 is disposed of. However, there shall be no order as to costs.

Since no affidavits are invited, the allegations contained in the petition are deemed not to be admitted.

Urgent certified website copy of this order, if applied for, be furnished to the parties on usual undertakings.
