The petitioner alleges that though the property of the petitioner has been utilized for the project by the Nadia Arsenic Division No.1, Public Health Engineering, no compensation in respect thereof has been paid to the petitioner. The petitioner submitted a representation dated 18th February, 2022 before the Executive Engineer Nadia Arsenic Civil Division-1, Public Health Engineering, being the fifth respondent praying for payment of appropriate compensation for the land utilized for the said authority. Mr. Kartick Kumar Bhattacharya, learned Advocate appearing for the petitioner submits that no decision on such representation has been communicated to the petitioner till date.

Mr. Bhattacharjee, learned Senior Standing Counsel submits that the decision on such representation shall be communicated to the petitioner within the time limit as may be fixed by this Court.

Without entering into the merits of the claim made by the petitioner in the representation dated 18th February,

2022, this writ petition stands disposed of by directing the Executive Engineer Nadia Arsenic Civil Division-I, Public Health Engineering, being the fifth respondent, to consider the said representation of the petitioner and dispose of the same by passing a reasoned order and communicate the same to the petitioner as expeditiously as possible but positively within a period of six weeks from the receipt of a server copy of this order along with a copy of the representation dated 18th February, 2022.

In case the authority decides in favour of the petitioner, consequential steps shall be taken by such authority in accordance with law.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
