Learned counsel appearing on behalf of the petitioner submits that the petitioner's husband was a laboratory assistant at the Christian College at Bankura. After his demise, the petitioner prayed for compassionate appointment, but the same has not been considered by the respondent authorities. Learned counsel appearing on behalf of the State, on instructions, submits that there is no scope for appointment of the petitioner on the ground of compassionate appointment. Therefore, the prayer of the petitioner cannot be acceded to. However, it is for the College to take a final decision at this stage in this regard. On instructions, it is further submitted that the question of giving compassionate appointment without a scheme is pending before the Hon'ble Apex Court.

Learned counsel for the College authorities submits that as there is no scope for compassionate appointment available in respect of the present service, no compassionate appointment can be allowed.

It appears that a representation of the petitioner praying for compassionate appointment is pending consideration before the College authorities.

Let the said representation be considered by the respondent no.4 in accordance with law and expeditiously, preferably within a period of eight weeks from the date of communication of this order.

However, it is clarified that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
