Heard learned counsels for the parties.
The petitioner submitted an application for grant of permanent permit for Inter-State route from Kolkata Central Bus Terminus at Santragachi to Markacho via Burdwan, Durgapur, Giridihi (Jharkhand) before the concerned authority on 30th June, 2021. In the meeting held by the authority on 24th August, 2021 the authority decided to keep the application of the petitioner along with two other applications pending for placing the same before the subsequent State Transport Authority's meeting in proper time along with other applications, if any, received in the meantime.
The petitioner's grievance is that his application or for that matter, the other applications also were not placed by the authority in the subsequent meetings in terms of the resolution taken on 24th August, 2021.
It is submitted on behalf of the respondents that the 2nd respondent be directed to act in terms of the resolution taken on 24th August, 2021 and place the application of the petitioner along with other connected pending applications in the subsequent meeting of the authority pertaining to the particular route.
In view of the above, the writ petition is disposed of directing the 2nd respondent to act in terms of the resolution taken in the meeting held on 24th August, 2021 in respect of the petitioner and the other similarly circumstanced persons in a subsequent meeting to be held not later than two months from this date and deal with the matter in accordance with law after affording reasonable opportunity of hearing to all the interested parties including the petitioner.
The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above directions, WPA 19205 of 2022 is disposed of. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be furnished to the parties upon compliance of necessary formalities.
