In the present matter, despite service, none appears for the private respondent.

Affidavit-of-service filed in court today be kept on record.

Learned counsel for the petitioner contends that, despite the petitioner having applied for a new electric connection to the petitioner's flat, the CESC Limited has failed to give such connection as yet.

Subsequently, it was intimated by the CESC Limited to the petitioner that the said connection was not being given due to an objection having been raised by the private respondent.

Learned counsel appearing for the CESC Limited submits that there is no impediment otherwise to give the connection to the petitioner, but such connection cannot

be given due to the objection raised by the private respondent.

In such view of the matter, WPA 19985 of 2021 is allowed, thereby directing the respondent nos.1 and 2 to ensure that an inspection is held at the premises of the petitioner for the purpose of giving a new connection. If subsequently found that it is feasible to give such connection, the CESC Limited shall give such connection to the petitioner within a reasonable period, subject to compliance of all formalities, at the existing of the electric meter board position at the premises.

In the event any obstruction is raised in such inspection and/or in giving new connection by the respondent no.4 and/or his men and agents, the CESC Limited officials will be at liberty to approach respondent no.3, the Officer-in-Charge, Tiljala Police Station for adequate police assistance in that regard.

If such approaches are made, respondent no.3 shall immediately grant adequate police protection at the time of inspection as well as while giving new electric connection, to the CESC personnel, at the cost of the petitioner.

It is made clear that in the event there is any padlock or other hindrance to the CESC personnel having access to the existing electric meter board position, the respondent no.3 shall be free to use force and, if necessary, a remove such padlock/hindrance for the

limited purpose of taking such inspection and giving new connection.

There will be no order as to costs.

Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
