Heard learned counsels for the parties.

It is contended on behalf of the petitioner that the petitioner is a stage carriage permit holder in the inter state route Midnapore to Tata and his permit is valid till August 02, 2025. Time table issued in favour of the petitioner for the said route is also valid till expiry of the permit. The petitioner alleges that the private respondent who is also holder of the stage carriage permit which is valid till December 05, 2023 was issued a time table on December 06, 2018 which is also valid till December 05, 2023. A further time table was issued in favour of the private respondent on June 17, 2019 which demonstrates an altered route alignment, a portion of which clashes with the time table issued in favour of the petitioner. According

to the petitioner, the subsequent time table is a forged document and needs to be verified by the authority. The petitioner seeks to submit a comprehensive representation in this regard before the concerned authority and prays for a direction upon the authority to consider the representation at the earliest.

Learned counsel for the State-respondents submits that the 3rd respondent be directed to consider the representation in accordance with law.

In view of the above, the writ petition is disposed of with liberty to the petitioner to submit a comprehensive representation before the 3rd respondent ventilating his grievance within one week from date. The 3rd respondent is directed to consider and dispose of the representation within six weeks from the date of receipt thereof after affording reasonable opportunity of hearing to all the stakeholders including the petitioner and the private respondent, in accordance with law.

The decision taken by the authority shall be communicated to the petitioner within a week thereof. With the above observations and directions this writ petition is disposed of.

There shall be, however, no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted.
