Petitioner has filed this writ petition being aggrieved by inaction on the part of the respondent WBGST authority concerned in refunding the amount which he is entitled on modified order of the appellate authority which comes to Rs.25,14,424/-.

Considering the facts and circumstances of the case and submission of the parties, the action of the WBGST authority concerned/respondent no.3, in not refunding the admitted refundable amount on the basis of modified order of the appellate authority in question is unjustified and he is directed to refund the aforesaid amount within two weeks from date of

communication of this order subject to completion of all the formalities if any required under the law. With this observation and direction, this writ petition being WPA 18848 of 2023 is disposed of. ( Md. Nizamuddin, J.)
