By this writ petition, petitioner has challenged the impugned order dated 12th August, 2022 issued by the Assistant Commissioner, State Tax, Bureau of Investigation (South Bengal)/respondent No.

asking the petitioner to pay the amount of penalty in question, on the ground that before issuing the aforesaid impugned notice dated 12th August, 2022 asking the petitioner to make payment for penalty, the respondent authority concerned have not considered his representation dated 10th August, 2022 and 16th August, 2022 requesting the authority concerned for providing him the photocopies of records seized on 20th July, 2022 from the registered place of business of the petitioner.

Considering the submission of the parties this writ petition being WPA 19227 of 2022 is disposed of by directing the respondent No. 2 to consider and dispose of the aforesaid representations dated 10th & 16th August, 2022 making prayer for providing photocopies of the records seized in accordance with law and by passing a reasoned and speaking order and after giving an opportunity of hearing to the petitioner or its authorized representatives within two weeks from the date of communication of this order. The petitioner will be at liberty to take further course of action on receipt of the same in accordance with law.

With this observation and direction this writ petition stands disposed of.
