Banerjee) Mr. Siva Prasad Ghose ...for the petitioner This application under Article 227 of the Constitution of India is at the instance of the 3rd defendant praying for a direction upon the learned Civil Judge (Jr. Division) 2nd Court at Barrackpore to dispose of Title Suit No. 80 of 2023 expeditiously. Mr. Ghose, learned advocate appearing for the petitioner submits that the petitioner herein has set up a counterclaim in the said suit. He further submits that the suit as well as the counterclaim should be directed to be disposed of expeditiously. In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite party. However, learned advocate for the petitioners shall be obliged to forward a copy of this application, along with a copy of the this order, upon the opposite party or the learned advocate representing the opposite party before the learned trial Judge.

In the light of the submission made by Mr. Ghose, learned advocate for the petitioner, CO 2788 of 2024 is disposed of by requesting the learned Civil Judge (Jr. Division), 2nd Court at Barrackpore to take up the hearing of Title Suit No. 80 of 2023 along with the counterclaim, if the same are otherwise ready for hearing and to make an endeavour to see that the suit along with the counterclaim, are disposed of as expeditiously as possible without granting any unnecessary adjournment to either of the parties.
