The wife/respondent of the Matrimonial Suit No. 762 of 2019 filed by the husband/opposite party before the learned District Judge at Howrah, is the petitioner of the present application under Section 24 of the Code of Civil Procedure. The petitioner by the present application is praying withdrawal and transfer of the said suit. Ms. Punam Basu, learned advocate appearing on behalf of the petitioner submits that the said matrimonial suit has already been withdrawn by the husband/opposite party. She further submits that as directed by the order dated January 06, 2021, Misc. Case no. 21 of 2019 for restoration of the Matrimonial Suit no. 405 of 2018 filed by the petitioner before the learned Additional District Judge at Kalyani, District-Nadia has already been disposed of.

In view of the aforesaid development, the present application has become infructuous and C.O. 3107 of 2019 is dismissed accordingly without any order as to costs. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
