The petitioner has challenged an order of the Administrator, Nanoor High School, dated March 7, 2018, by dint of which the said authority has rejected petitioner's prayer to continue to impart education to the students of the school as a part of his benevolent act.

The authorities have held as follows:- "After verification of papers it is found that the school authority did not take prior permission from the competent authority for such engagement. As per Memo No. 1380(20)/GA dated 27.09.1996 of the Directorate of School Education, WB, any appointment/engagement in the post of teaching category without taking prior permission from competent authority & without following the recruitment rules is the gross violation of the existing rules and regulation. After promulgation of The West Bengal school ( Control of expenditure ) Act 2005 there is no provision of school authority to engage any teaching staff. So the school authority of the said school violation the existing rules & acts. Hence the application of the petitioner is rejected. All concern are being informed accordingly."

Mr. Abdus Salam, learned counsel is appearing for the writ petitioner and no one is appearing for the respondents.

Upon consideration of the reasons shown by the respective respondent authorities in the order dated

March 7, 2018 has quoted above, the Court finds no illegality or infirmity therein.

The Court considers that there would not be any cogent reason to interfere into the same.

For the reasons as above, this writ petition being WPA No. 18248 of 2018 is dismissed.
