Learned advocate appearing for the petitioner is anxious regarding the progress of the case as the petitioner is in custody since October, 2019, which is more than 26 months.

Learned advocate appearing for the petitioner has drawn the attention of this court to the fact that the chargesheet was filed on 16th October, 2021. Subsequently, supplementary chargesheet was filed and finally charge was framed on 25th August, 2021.

It is contended that till date no witness has been examined.

Having regard to the agony expressed by the learned advocate for the petitioner, I am of the opinion that a schedule must be fixed for at least three days in every 75 days.

No unnecessary adjournments should be granted to either of the parties and a date/schedule should be fixed by the learned court once the Public Prosecutor assures the court regarding the availability of the witnesses, since most of the witnesses belong to the Police Department/Government Department, the court should insist the appearance of the concerned witnesses on the dates so specified. All efforts must be taken by the learned court so that the trial can be taken to its logical conclusion within a reasonable period of time.

With the aforesaid observations, the criminal revisional jurisdiction being CRR 2487 of 2021 is disposed of. All parties are to act on the server copy of this order duly downloaded from the official website of this court. ( Tirthankar Ghosh, J. )
