None appears for the private respondents despite service.

Heard learned counsels for the parties.

Alleging unauthorised construction made by the private respondents by encroaching upon PWD land, the petitioner submitted a representation before the concerned authority pursuant to which the authority has initiated proceedings under Section 10 of the West Bengal Highways Act, 1964 and has taken the proceedings to its logical conclusion upon passing an order under Section 10(3) of the Act.

The instructions submitted on behalf of the State respondents demonstrate that the concerned Assistant Engineer, vide memo dated 19th January, 2024, requested Inspector-in-Charge, Krishnaganj Police Station to fix up a

date and time of the eviction programme for police assistance in maintaining law and order and making other arrangements.

In view of the above, nothing further remains to be adjudicated in the present writ petition and the same is disposed of. However, it is expected that the eviction programme will be held within two weeks from the date of communication of this order.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to be admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
